1. Agreement To Terms

These Terms of Use ("Terms") form a legally binding agreement between you ("you," "your," or "user") and Educacion Global, Inc. ("Educacion Global," "we," "us," or "our") governing your access to and use of the Origami World mobile application, website, and any related services, features, or content (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to every part of these Terms, you must immediately stop using the Service and, if applicable, uninstall the application. Your continued use of the Service after any modification to these Terms constitutes your acceptance of the modified Terms.

2. Eligibility

You represent and warrant that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher) and have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and supervises your use of the Service. Educacion Global reserves the right to refuse or terminate access to the Service for any user who does not meet these eligibility requirements, at its sole discretion and without notice.

3. The Service

Origami World enables users to discover, download, preview, and place 3D creations using supported device features such as maps, QR scanning, local storage, camera access, and augmented reality ("AR") preview. Certain features may require an active internet connection, location permission, camera permission, sufficient device storage, or compatible hardware and operating system versions. Educacion Global does not guarantee that any specific feature will be available, function correctly, or remain available on any particular device, operating system version, or geographic region.

Educacion Global reserves the right, at any time and without prior notice or liability, to modify, suspend, discontinue, restrict, or remove any part of the Service, any feature, or any content, in whole or in part, temporarily or permanently.

4. Accounts And Device Identity

An account is not required for the core app experience. The app may use a device-generated identity or token to register the device, authenticate requests, and protect the Service from abuse. If Apple Sign In or any other authentication method is offered, it is optional unless a specific feature requires account synchronization. You are solely responsible for maintaining the confidentiality of any credentials, tokens, or device identifiers associated with your use of the Service and for all activity that occurs under your device identity, whether or not authorized by you. You must notify us immediately of any unauthorized use or suspected security breach.

5. License Grant And Restrictions

Subject to your compliance with these Terms, Educacion Global grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Service on a device that you own or control, solely for your own personal, non-commercial use.

You shall not, and shall not permit any third party to: (a) copy, modify, adapt, translate, or create derivative works of the Service or any content therein; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, underlying ideas, or data structures of the Service; (c) rent, lease, lend, sell, sublicense, distribute, or otherwise transfer rights to the Service; (d) remove, alter, or obscure any proprietary notices, labels, or marks on the Service; (e) use the Service to build a competing product or service; (f) use any automated system, including bots, scrapers, or crawlers, to access the Service; (g) circumvent, disable, or otherwise interfere with security-related features of the Service; or (h) use the Service in any manner not expressly authorized by these Terms. Any rights not expressly granted herein are reserved by Educacion Global.

6. Acceptable Use

You agree that you will not, under any circumstances: (a) misuse, disrupt, or interfere with the Service, its servers, or networks; (b) attempt to gain unauthorized access to the Service, other users' data, or any systems or networks connected to the Service; (c) submit, transmit, or introduce any virus, malware, malicious code, or harmful data; (d) impersonate any person or entity or misrepresent your affiliation; (e) upload, post, or transmit any content that is unlawful, defamatory, obscene, harassing, threatening, infringing, or otherwise objectionable; (f) engage in any activity that violates any applicable local, state, national, or international law or regulation; (g) use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service; or (h) harvest or collect data about other users without their consent. Violation of this section may result in immediate suspension or termination of your access to the Service, at Educacion Global's sole discretion, without notice and without liability to you.

7. Content, Downloads, And Intellectual Property

The Service, including all 3D models, images, text, graphics, logos, icons, audio, video, software, metadata, location data, collections, designs, and other materials made available through the Service (collectively, "Content"), and all intellectual property rights therein, are owned by Educacion Global, Inc., its licensors, or its content partners, and are protected by copyright, trademark, trade secret, patent, and other intellectual property laws of the United States and other countries. Nothing in these Terms transfers any ownership interest in the Content or the Service to you.

Content may be added, updated, restricted, removed, or made unavailable at any time without notice. Any Content downloaded through the Service is licensed, not sold, to you and is provided solely for your personal, non-commercial use within the app, unless separately authorized in writing by Educacion Global. You may not extract, repurpose, redistribute, publicly display, sell, or commercially exploit any Content without our prior written consent.

If you submit, upload, or otherwise provide any feedback, suggestions, ideas, or other materials to Educacion Global regarding the Service ("Feedback"), you grant Educacion Global a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, without any obligation, attribution, or compensation to you.

8. Creators Program And User-Submitted Assets

Origami World may offer a "Creators Program" or similar feature that allows you to upload, submit, or contribute 3D assets, models, logos, textures, images, designs, or other original works ("Submitted Assets") for potential inclusion, display, distribution, or promotion within the Service. Participation in the Creators Program is voluntary and constitutes your acceptance of this Section in addition to the rest of these Terms.

License Grant. By uploading, submitting, or otherwise contributing any Submitted Asset through the Service, you grant Educacion Global, Inc. an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable (through multiple tiers) license to host, store, reproduce, distribute, publicly display, publicly perform, adapt, modify, create derivative works from, translate, format, feature, promote, advertise, and otherwise commercially and non-commercially exploit the Submitted Asset, in whole or in part, in any media, formats, or channels now known or later developed, without any obligation to compensate, attribute, or notify you, and without any time limitation. This license survives your discontinued use of the Service, the removal of the Submitted Asset from public view, and the termination of these Terms.

Commercialization. You acknowledge and agree that Educacion Global may use Submitted Assets for any commercial purpose, including but not limited to featuring them in marketing, advertising, promotional campaigns, partnerships, merchandise, in-app purchases, licensing to third parties, sponsorships, or any other revenue-generating activity, without any payment, royalty, revenue share, credit, or other consideration owed to you, unless a separate written agreement signed by an authorized representative of Educacion Global expressly states otherwise.

Representations And Warranties. By submitting any Submitted Asset, you represent and warrant that: (a) you own all right, title, and interest in the Submitted Asset, or you have obtained all necessary rights, licenses, consents, and permissions to submit it and to grant the license described in this Section; (b) the Submitted Asset does not infringe, misappropriate, or violate any third party's copyright, trademark, patent, trade secret, moral right, right of publicity or privacy, or any other intellectual property or proprietary right; (c) the Submitted Asset does not contain any unlawful, defamatory, obscene, or otherwise objectionable material; and (d) the Submitted Asset does not contain any virus, malware, or other harmful code.

Removal And Moderation. Educacion Global reserves the right, but has no obligation, to review, screen, moderate, refuse, remove, or disable access to any Submitted Asset at any time, for any reason or no reason, in its sole discretion, without notice or liability to you. Removal of a Submitted Asset from the Service does not revoke or limit the license already granted under this Section with respect to any use, copy, or derivative made prior to removal.

No Confidentiality. You acknowledge that any Submitted Asset is provided on a non-confidential basis, and Educacion Global has no obligation to keep any Submitted Asset confidential or to refrain from developing, using, or distributing similar or competing assets, whether or not derived from your submission.

This Section is a material inducement for Educacion Global to operate the Creators Program, and you agree it will survive indefinitely, regardless of whether you later close your account, uninstall the app, or otherwise cease using the Service.

9. Trademarks

"Origami World," the Origami World logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Educacion Global, Inc. or its affiliates. You may not use these marks without our prior written permission. All other names, logos, and marks appearing on the Service are the trademarks of their respective owners.

10. Safety And Physical Use Of AR Features

YOU ASSUME ALL RISK ASSOCIATED WITH USE OF AUGMENTED REALITY, CAMERA, MAP, AND LOCATION-BASED FEATURES. When using AR, camera, map, navigation, or location features, you must remain aware of your physical surroundings at all times, obey all applicable traffic laws and local rules, avoid restricted, private, or dangerous areas, and never use the Service while driving, operating machinery, or in any other situation requiring your full attention. Educacion Global is not responsible for any injury, property damage, accident, or loss resulting from your use of the Service in physical environments, including collisions, falls, trespassing, or exposure to hazards.

11. Third-Party Services And Links

The Service may integrate with, rely on, or link to third-party platforms, services, or content, including but not limited to Apple Maps, Apple Sign In, camera APIs, AR frameworks, app stores, and analytics providers ("Third-Party Services"). Third-Party Services are governed by their own terms of service and privacy policies, and Educacion Global has no control over and assumes no responsibility for the content, accuracy, availability, or practices of any Third-Party Service. Your use of any Third-Party Service is at your own risk and is subject to the terms and policies of the applicable third party. Educacion Global disclaims all liability arising from or related to your use of Third-Party Services.

12. Disclaimer Of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. EDUCACION GLOBAL, INC. DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE SERVICE WILL BE COMPATIBLE WITH ANY PARTICULAR DEVICE, OPERATING SYSTEM, OR HARDWARE; (C) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (D) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (E) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

13. Limitation Of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDUCACION GLOBAL, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT EDUCACION GLOBAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF EDUCACION GLOBAL, INC. ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO EDUCACION GLOBAL FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to defend, indemnify, and hold harmless Educacion Global, Inc., its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual property, privacy, or publicity rights; (d) your violation of any applicable law or regulation; or (e) any content or data you submit, post, or transmit through the Service. Educacion Global reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

15. Termination

Educacion Global reserves the right to suspend, restrict, or terminate your access to all or any part of the Service, at any time, with or without notice, with or without cause, and without liability to you, including if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to Sections 7, 8, 9, 12, 13, 14, 17, and 18) shall survive any termination or expiration of these Terms.

16. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information. By using the Service, you consent to the data practices described in the Privacy Policy.

17. Governing Law And Dispute Resolution

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles, except where preempted by applicable federal law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including its formation, breach, or validity, shall be resolved exclusively through binding arbitration administered in accordance with the rules of a recognized arbitration association, on an individual basis only. YOU AND EDUCACION GLOBAL EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. Any arbitration shall be conducted on an individual basis and shall not be consolidated with any other arbitration or proceeding. Notwithstanding the foregoing, either party may bring an individual action in small claims court, and Educacion Global may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

18. Severability And Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed, and the remaining provisions of these Terms shall remain in full force and effect. The failure of Educacion Global to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Educacion Global on the Service, constitute the entire agreement between you and Educacion Global concerning the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Educacion Global with respect to the Service.

20. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without the prior written consent of Educacion Global. Educacion Global may assign or transfer these Terms, in whole or in part, without restriction or notice to you, including in connection with a merger, acquisition, reorganization, or sale of assets.

21. Changes To These Terms

Educacion Global reserves the right to modify or replace these Terms at any time, at its sole discretion. If a revision is material, we will make reasonable efforts to notify users, such as by posting a notice within the Service or updating the "Last updated" date above. It is your responsibility to review these Terms periodically. Your continued access to or use of the Service after any such changes take effect constitutes your acceptance of the revised Terms.
